HOCKETT, Minor Opinion Published: 10/21/2021 Judge Stephens, Author; and Judges Murray and Kelly on panel  Docket No. 353132 Wayne County Circuit Court Read Opinion Here Holding: The Court affirmed the trial court’s exercise of jurisdiction over the minor child, as culpability is not a prerequisite for probate court intervention under MCL 712A.2(b); however, it called on the Michigan Legislature to develop policies in which the State should provide different avenues for parents, who are dealing with children in mental health crisis, other than finding a parent unfit and having the trial court assuming jurisdiction over the child.  Facts: In October 2019, CPS was contacted by hospital staff when Mother refused to retrieve NRH, who has multiple mental health diagnoses, from the hospital. A CPS worker testified that she contacted Mother and Mother agreed to pick up NRH from the hospital. CPS was

Redistricting update and more, from Ottawa Impact - 10/21/21

Image
From Joe Moss, Founder of OttawaImpact.com The generous people of Ottawa County have helped the   Legal Fund   raise $52,195 to support the parents who filed a legal complaint against the Ottawa County Commissioners and Health Department. Thank you!! (This is 52% of our goal.) We will share more updates as they are available. Please share this update with your family and friends, and let them know how the Ottawa County leadership views the mask mandate as harmless: Your friends and family can stay up-to-date on local issues by  becoming a member  of Ottawa Impact. Government overreach must be challenged. Ottawa County needs new leaders, for new times, for liberty! Redistricting Action Item We have one final opportunity to make an impact on the state level with the "independent" redistricting commission. The redistricting commission is tasked with drawing new lines every 10 years. This is an important issue because several of the maps  divide Ottawa County  into three federa

New Legislation would repeal state’s pistol registry - A note from Senator Lana Theis

Note:  These bills have not been reviewed by Katherine Henry, but they appear to be a step in the right direction. " New Legislation would repeal state’s pistol registry.. Bills recently introduced in the state Senate by myself and colleague Sen. Tom Barrett would repeal Michigan’s pistol registry and require law enforcement to destroy all associated records. Law-abiding Michigan residents have a constitutional right to keep and bear arms. The government has no right or need to know whether a law-abiding adult owns a pistol and legal gun owners should not have to register their firearms with the state. This legislation would help restore our natural rights as citizens of this country by repealing Michigan’s pistol registry and requiring law enforcement to destroy all records thereof. Senate Bills  646 - 648  would eliminate the pistol registry from state law. It would also require the state police and sheriffs and heads of police from each county, township, city and village throug

Ottawa Impact Lawsuit Fundraising Update - 10/18/21

Image
From Joe Moss, Founder of  OttawaImpact.com The  Legal Fund  has raised $49,955 to support the lawsuit against the Ottawa County Commissioners and Health Department. The leaders in Ottawa County are committed to keeping our kids masked. They are ignoring the facts that adults who wanted the shots have had time to get them, and the risk to children of hospitalization and/or death is essentially zero, as reported by the county itself. Even the CDC recognizes that: "Most children with [the virus] have mild symptoms or they may have  no symptoms  at all." If you  donate $45  right now, you will help us reach the halfway point of $50,000! Please keep in mind how the Ottawa County leadership views the mask mandate: Government overreach must be challenged.  Ottawa County needs new leaders for new times, who understand and prioritize the principles of liberty set forth by our Founding Fathers. Donate Now This lawsuit is an opportunity for everyone to take action together, which is wh

Ottawa Impact Lawsuit Update - 10/16/21

Image
From Joe Moss, Founder of OttawaImpact.com Ottawa County responded to the lawsuit. You can see their response and other updates   on the website . It all boils down to this:  Ottawa County leadership is working hard to fight the lawsuit, to keep kids masked in school, prioritizing their interests above the health of our children and parental rights. Interestingly, Ottawa County issued a  new  public health order last Friday. It begins by saying: "The Administrative Health Officer makes the following  factual determinations  to reconcile the orders considering current facts and law" Presumably, they issued this "fix-it" order in response to the lawsuit. As you know, the lawsuit challenges that  the county failed to make factual determinations regarding "imminent harm" to support their mask order, and this was how they tried to fix their error. It is now apparent that Ottawa County has coined a new term, which you will see in their response:  "harmless

Redistricting Information from the GOP

Keeping our fingers crossed….the Michigan Redistricting Commission is finally set to hold their mapping hearings, beginning on October 20th.  I am including a fresh google form for our trainings with the updated hearing dates.  Please fill out the form as soon as possible.   There is a lot of information here, so please read this email in its entirety.  This is the last opportunity for us to give feedback on these maps that will guide our legislative bodies for 10 years. Below is a list of hearings with the associated trainings that are currently scheduled.  It is advisable to participate in the training associated with your hearing, but it is not necessary.  We will be focusing the trainings on the regions where the hearings are scheduled to help give specific guidance on the maps for those areas. As a reminder, you must still register for your specific hearing prior to attending and you can do it through the following link.  MICRC - Meeting Notices & Materials (michigan.gov) .

Update from Ottawa Impact 10/04/21

Facebook is down, and so are mask mandates in other counties. Ottawa Impact is online, and since we rely on email to communicate directly with Impacters like yourself, we can still share the latest news. Ottawa County will  not  drop the Mask Order for pre-K through 6th grade students. However, since the governor signed  Public Act 87 , health departments covering the following counties have  removed  their mask mandates: Allegan Barry Branch Berrien Dickinson Eaton Hillsdale Iron St. Joseph Public pressure is a major factor in these decisions. County officials also cited Section 1222 (4) of Public Act 87: If a local health officer has an emergency order under section 2453 of the public health code, 1978 PA 368, MCL 333.2453, in effect as of October 1, 2021,  the funds appropriated in part 1 for essential local public health services are unappropriated. Section 250 of Public Act 87 states: The director or a local health officer  shall not issue  or enforce any orders or other directi

From Kent County GOP 9/30/21

Yesterday,  the  MI Independent Citizens Redistricting Commission  went rogue by drawing a congressional district draft map that includes the City of Grand Rapids with the City of Kalamazoo. Who has advocated for them to do this? No one! Grand Rapids and Kalamazoo have little in common and should NOT be considered a community of interest. The current maps also split many of the suburban areas of Grand Rapids from the City in a separate congressional district, including Ada, Sparta, Cedar Springs, Rockford, Lowell. Instead, these areas would be drawn in a congressional district all the way to the City of Midland! If you're from one of these suburbs, you don't say you're from Midland, you say you're from Grand Rapids. Clearly this was drawn to benefit the Democratic Party by packing their voters within one Congressional District.  We cannot let this happen! We need YOUR help to send a message to the Commission to reject this proposed map. Here are four ways you can help:

An Update from Ottawa Impact 09/30/21

The Michigan Legislature included the following   language   in the budget that was signed yesterday by the governor: "The director or a local health officer  shall not issue or enforce  any orders or other directives that require an individual in this state who is  under the age of 18 to wear a face mask  or face covering." ( mi.gov ) Question:   Will Ottawa County disregard the prohibition on mask mandates in Public Act 87 of 2021? Read Public Act 87 of 2021 on mi.gov YES, Ottawa County commissioners, on advice from Corporation Counsel Doug Van Essen, confirmed they will disregard the prohibition on forced masking in Public Act 87, risk state funding, and uphold the forced Mask Order on young students. Reports are circulating that the following counties are lifting their mask orders: Allegan County Berrien County Ionia County This is why the  lawsuit  filed against Ottawa County is so important! The rule of law must be followed. The lawsuit challenges the authority Ottawa
